In a significant legal move, tech billionaire Elon Musk has initiated a lawsuit against OpenAI and Microsoft, accusing them of engaging in anti-competitive behavior within the artificial intelligence sector. The motion was filed in the US District Court for the Northern District of California on November 29.

The legal documents name key figures such as OpenAI CEO Sam Altman, president Greg Brockman, and former board members Reid Hoffman and Dee Templeton, who is also affiliated with Microsoft. Musk’s team claims that OpenAI has hindered investors from funding rival companies, specifically targeting Musk’s AI venture, xAI.

According to the filing, Musk has evidence that at least one major investor in OpenAI’s October funding round subsequently opted against investing in xAI. The lawsuit further contends that the collaboration between OpenAI and Microsoft constitutes illegal self-dealing, damaging competition within the market.

Of particular interest, Musk’s lawyers allege that OpenAI favored certain organizations with which they have financial ties, such as choosing Stripe as their payment processor due to Altman’s ownership stake in the platform. The motion stresses the necessity of preserving OpenAI’s initial nonprofit character, claiming it has strayed far from its founding mission.

OpenAI has responded vigorously to the allegations, stating through a spokesperson to TechCrunch that Musk’s claims are unsubstantiated. “Elon’s fourth attempt, which again recycles the same baseless complaints, continues to be utterly without merit,” the representative remarked.

Previously, Musk had filed a similar lawsuit against OpenAI in February, accusing the organization of abandoning its original goal of making AI benefits accessible to all. Although that lawsuit was initially withdrawn, it was refiled shortly thereafter.
