India Strengthens Consumer Rights with New Dark Patterns Guidelines

The Central Consumer Protection Authority (CCPA) has issued an advisory to all e-commerce platforms in India, urging them to undertake necessary measures to eliminate deceptive and unfair trade practices, specifically focused on dark patterns. These visual and interface tricks are designed to manipulate consumers and influence their decisions unfairly.

The advisory states that all platforms should carry out self-audits within three months to detect any dark patterns. Following this, platforms are encouraged to submit self-declarations affirming they do not employ such practices. This initiative aims to foster a transparent and trustworthy digital marketplace.

Furthermore, the CCPA has issued notices to several platforms found violating guidelines related to dark patterns. The authority is actively monitoring and will continue to scrutinize practices that mislead consumers through deceptive design interfaces.

A dedicated joint working group, comprising representatives from various government ministries, regulators, consumer organizations, and natural law universities, has been formed to oversee the implementation of these measures. This group will also promote awareness among consumers about recognizing and avoiding dark patterns.

In 2023, the Department of Consumer Affairs had already issued guidelines identifying 13 types of dark patterns such as false urgency, basket sneaking, and bait-and-switch tactics, among others. The goal is to safeguard consumers from manipulative online shopping practices and ensure fair play in the digital economy.
